Subzz (Pty) Ltd Terms and Conditions
1. Introduction
Welcome to Subzz (Pty) Ltd, a private company incorporated in the Republic of South Africa.
These Terms and Conditions (“Terms”) govern your use of our subscription service for access to physical products (“Service”). By subscribing to a product through Subzz, you agree to be bound by these Terms. Please read them carefully before proceeding.
2. Definitions
- “Subzz” / “we” / “us” / “our” – Subzz (Pty) Ltd
- “you” / “your” – the consumer who subscribes to a product via our platform
- “Product” – the item you access through a subscription (e.g., golf equipment, electronics, appliances, etc.)
- “Subscription Term” – the fixed duration (12, 18, or 24 months) during which you pay for access to the Product
- “Platform” – the Subzz website or app used to manage your subscription
- “Merchant” – the third-party retailer or supplier that sells the product to Subzz
3. How the Service Works
3.1 Subzz enables you to subscribe to use selected products for a fixed term in exchange for a recurring monthly fee.
3.2 You do not own the Product — you have the right to use it for the duration of the Subscription Term, subject to these Terms.
3.3 At the end of the term, you must either:
- Return the Product to Subzz in good condition (normal wear and tear allowed); or
- Extend your subscription (if available).
4. Ownership
4.1 The Product remains the property of Subzz at all times.
4.2 You may not sell, lease, pledge, lend, or otherwise dispose of the Product.
5. Subscription Duration and Payment
5.1 Subscriptions are available for 12, 18, or 24-month terms.
5.2 Monthly fees will be automatically charged to your nominated card.
5.3 By subscribing, you authorise Subzz to collect monthly payments until the end of the Subscription Term.
5.4 Subzz reserves the right to suspend or cancel your access if payment fails after reasonable attempts.
6. Early Cancellation
6.1 You may cancel your subscription before the end of the term.
6.2 However, you will remain liable for the full outstanding balance of the subscription.
6.3 You must return the Product promptly if cancelling early. Late returns may incur additional fees.
7. Delivery and Returns
7.1 Delivery timelines will be communicated during checkout.
7.2 You must ensure the correct delivery address and accept the Product upon arrival.
7.3 At the end of the term (or upon cancellation), you must return the Product in its original packaging (if possible), with all included accessories.
7.4 You may be charged for:
- Lost items
- Excessive damage
- Missing components
8. Refunds
Our refund policy is dependent on the merchant or provider from whom the product was purchased. We do not handle refunds directly and therefore have play no role in governing cancellation or refund charges. Any refund or cancellation is subject to the specific terms and conditions of the merchant involved.
9. Care and Usage
9.1 You are responsible for keeping the Product in good working condition.
9.2 Do not attempt to modify, disassemble, or repair the Product.
9.3 Use the Product only for its intended purpose and in accordance with the manufacturer’s instructions.
10. Cover and Risk
10.1 Subzz provides basic cover for theft, accidental damage, and loss.
10.2 In the event of theft or damage, you must:
- Report the incident to Subzz within 48 hours
- Submit a police report (for theft)
- Cooperate with the claims process
10.3 Cover is subject to approval.
11. Faults and Replacements
11.1 If your Product is faulty due to a manufacturing defect, Subzz will repair or replace it.
11.2 Normal wear and tear or misuse is not covered under this policy.
12. Your Account
12.1 You must create an account with accurate personal and payment information.
12.2 You are responsible for all activity on your account.
12.3 Subzz reserves the right to suspend or close accounts suspected of fraud or misuse.
13. Privacy and Data Use
13.1 Your personal information will be processed in accordance with the Protection of Personal Information Act (POPIA).
13.2 We may share data with third parties (e.g., payment processors, delivery partners) only as required to fulfil our service.

14. Limitation of Liability
14.1 Subzz will not be liable for:
- Loss of profit, revenue, or opportunity
- Indirect or consequential losses
14.2 Our liability for any claim is limited to the total subscription fees paid by you.
15. Breach and Termination
15.1 If you breach these Terms, Subzz may:
- Suspend or terminate your subscription
- Require immediate return of the Product
- Charge the outstanding subscription balance
15.2 Non-payment is considered a material breach.
16. Changes to Terms
16.1 Subzz may update these Terms from time to time.
16.2 You will be notified of material changes, and continued use of the platform will constitute acceptance.
17. Governing Law and Disputes
17.1 These Terms are governed by the laws of the Republic of South Africa.
17.2 Any disputes may be resolved by arbitration or in a competent South African court.
17.3 You may also refer disputes to the Consumer Goods and Services Ombud.
